Code - Ordinances/laws that are enforcable by the local government
Subdivision Regulations - For the purpose of making the administration of the Subdivision Regulations comport with past practice and State Law; placing site plan criteria in said regulations; defining the duties of Town officials and developers under the regulations; clarifying that the Planning Commission shall be the sole body responsible for approval of record plats and other planning functions; establishing the process for filing and approval of preliminary plats and the recordation of final plats of subdivision; providing for the dedication and reservation of streets and other property; requiring that adequate public facilities exist for land proposed to be subdivided; establishing standards for the construction of proposed streets and roads; requiring reforestation; providing standards for development by cluster subdivision; regulating non-tidal wetland, flood plains and unsafe land; establishing a procedure for creating and enforcing (by bond, etc.) public improvement agreements; and providing a procedure for granting variances from the strict application of said regulations.
Zoning - Establishing new and existing uses in the Town which are permitted, permitted by special exception or prohibited; requiring reforestation; establishing residential zone of 1/3, 1/2, and 3/4 acre lot sizes, as well as a Rural Density Transfer zone, a Townhouse Dwelling Unit zone, a General Commercial zone and a Central Business District zone; providing standards and procedures for obtaining special exceptions for uses before the Board of Zoning Appeals; setting forth development and site plan standards for construction and placement of primary and accessory buildings in all zones; establishing off-street parking requirements for proposed uses in the Town; creating regulations governing the placement, size, content etc. of existing and proposed signs in the Town and for enforcement of such; providing for the establishment of a Sign Review Board; setting forth regulations governing the Board of Zoning Appeals, its composition, powers, duties and hearing procedures; providing requirements and procedures for local, sectional and district map amendments and text amendments; requiring building and use permits in the Town; requiring compliance with the zoning code generally and providing for its enforcement;
